Terms and Conditions

Terms and Conditions Velux reserves the right to change these Terms of Use at any time, effective immediately upon amending it. Please check this page periodically. We will note when there are updates to the Terms of Use at the bottom of the Terms of Use. If you violate these Terms of Use, Velux may terminate your use of their services, and/or take appropriate legal action against you.

  1. OPERATION. United Arab Emirates is Velux country of domicile. Velux is located in the U.A.E. Velux makes no representation that its services/products are appropriate for use in other locations. If you use its services/products from other locations you are responsible for ensuring compliance with local laws. You may not use, export or re-export any materials in violation of any applicable laws or regulations, including, but not limited to any U.A.E export laws and regulations.
  2. APPLICABLE LAW. The Laws of the United Arab Emirates shall govern the use of the services/products and the Terms of Use, without regards to conflict of laws principals. All disputes arising in connection therewith shall be heard only by a court of competent jurisdiction in U.A.E.
  3. MULTI-CURRENCY PRICED TRANSACTION. The displayed price and currency selected by you, will be the same price and currency charged and printed on the transaction receipt.
  4. PURCHASES. Velux accepts payment by Visa or Mastercard debit and credit cards in AED for its products and services. All online purchases are also governed by the terms and conditions of respective merchant service providers. Please review respective Telr Merchant Service Provider’s Agreement and Privacy Policy before entering any transaction

Booking terms

  • Booking confirmation is subject to 50% advance or full Payment.
  • Balance 50% on prior to the service commence.
  • In case of credit card payment 3.5% processing fee will be charged.
  1. INTERPRETATION. These Terms of Use supersede all other written and oral communications or agreements with regard to the subject matters discussed in these Terms of Use. A waiver or modification of these Terms of Use will only be effective if made in writing signed by an authorized officer of Velux. All refunds will be made onto the original mode of payment.
  2. OFFICE FOREIGN ASSETS CONTROL (OFAC) SANCTIONED COUNTRIES. Velux will not trade with or provide any services/products to individuals and companies owned or controlled by, or acting for or on behalf of, OFAC targeted countries and individuals, groups, and entities, such as terrorists and narcotics traffickers designated under the OFAC programs that are not country specific.
  3. REPRESENTATIONS BY YOU. By using this payment link, you represent, warrant and covenant that (a) you are at least 18 years old; (b) that all materials of any kind submitted by you to Velux through payment link will not plagiarize, violate or infringe upon the rights of any third-party including trade secret, copyright, trademark, trade dress, privacy, patent, or other personal or proprietary rights. The customer using the payment link who are Minor /under the age of 18 shall not register as a user of the payment link and shall not transact on or use the payment link.
  4. DISCLAIMER OF WARRANTY, LIMITATION OF DAMAGES. COMPANY MAKES NO WARRANTY OR REPRESENTATION OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTY OF TITLE OR NON-INFRINGEMENT OR IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT OR OTHER VIOLATION OF RIGHTS IN RELATION TO THE AVAILABILITY, ACCURACY, VALIDITY, RELIABILITY OR CONTENT OF THESE PAGES AND/OR THE SITE. COMPANY ALSO DOES NOT MAKE ANY REPRESENTATION OR WARRANTY REGARDING THE ACCURACY OR RELIABILITY OF ANY ADVICE, OPINION, STATEMENT OR OTHER INFORMATION THAT IS SUBMITTED, DISPLAYED OR UPLOADED THROUGH THE SITE BY ANY USER. COMPANY SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES, LOST PROFITS OR FOR BUSINESS INTERRUPTION ARISING OUT OF THE USE OF OR INABILITY TO USE THIS SITE, EVEN IF COMPANY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. SOME JURISDICTIONS DO NOT ALLOW EXCLUSION OF CERTAIN WARRANTIES OR LIMITATIONS OF LIABILITY, SO THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU. THE LIABILITY OF COMPANY WOULD IN SUCH CASE BE LIMITED TO THE GREATEST EXTENT OF LIABILITY PERMITTED BY LAW.
  5. VIOLATION OF TERMS OF USE. You understand and agree that in Velux’s sole discretion, and without prior notice, Velux may terminate your access to the payment link, or exercise any other remedy available and remove any unauthorized user information, if Velux believes that the information you provide has violated or is inconsistent with these Terms of Use, or violates the rights of Velux, or any third party, or violates the law. You agree that monetary damages may not provide a sufficient remedy to Velux for violations of these Terms of Use and you consent to injunctive or other equitable relief for such violations. Velux may release user information about you if required by law or subpoena.
  6. LICENCE GRANTED TO YOU. By providing materials to Velux including by submitting or uploading content or materials for use on the payment link you represent and warrant that you or the owner of all rights to such content or materials has expressly granted Velux an irrevocable world-wide right in all languages and in perpetuity to use and exploit all or any part of the content and materials provided by you. Velux may publish and distribute any such submitted content or materials at its sole discretion by any method now existing or later developed. You agree that you shall waive all claims and have no recourse against Velux for any alleged or actual infringement or misappropriation of any proprietary rights in any communication, content or material submitted to Velux. Any communication or materials you send to Velux will be treated as non-confidential and non-proprietary and may be disseminated or used by Velux for any purpose, including, but not limited to, developing, creating, manufacturing or marketing products or services.
  7. SEVERABILITY. If any provision of the Terms of Use is held to be invalid, void or unenforceable, the remaining provisions shall nevertheless continue in full force and effect.
  8. Online payment Policy

Any person paying online should use their own personal credit or debit cards. If not, then the service may not be awarded.

  1. REFUND
  • Refund is granted under the below Cancellation terms and deadlines
  • Full refund can only be applied if the coast guard don’t approve the vessel to leave the harbour because of external conditions like bad weather, rough sea or any other conditions that can damage the vessel or bring the clients in danger.
  1. CANCELLATION

Car rental:

  • Cancellations outside of 24 hrs from the charter will incur Full refund.
  • Cancellations within 24 hrs of the charter will incur 1000 AED charge.

Yacht Charter:

  • Cancellations outside of 72 hrs from the charter will incur a 50% charge.
  • Cancellations within 72 hrs of the charter will incur 100% charge.
  1. RestrictionsCar rental

Smoking in our vehicles is strictly prohibited as it damages our vehicles and is a safety hazard while driving. Smoking in our vehicles may result in a charge of up to AED 1000. Driver must return the car in the same condition they received it, if the car is dirty or has any food leftovers or stains, this will result in a charge. Off-roading, rallying, racing or ‘drifting’ in our vehicles is strictly prohibited. going to deserts, and tracks is not allowed and will result to breach of contract. Customer is not allowed to drive over 160km/h, if the driver goes over this speed limit he will be warned on the 1st attempt, and charged 2000 AED on the 2nd attempt, and on the 3rd attempt we will shut down the car, and the remaining rental period will not be refunded. Pets may be allowed in our vehicles; however, cleaning and damage penalties will be charged, without exceptions.

  1. Mileage Usage – Car rental

Our offer is based on a maximum use based on the number of kilometers stated in your contract, typically 250KM per day, 1500KM per week or 4000KM per month. Excess usage will be charged at the rate of AED (25-50 AED) per KM, depending on the car.

 

Salik (Toll Charge) and Traffic Fines The Salik (toll) charged will be the toll amount (typically AED 4), plus an AED 1 service fee, plus VAT on the service fee component Traffic fine charges will be the actual fine, plus an AED 50 service fee, plus VAT on the service fee component. We will inform you as soon as we get a notification from the concerned authorities. If the fine caused the car to be impounded, additional fee ranging from 100 – 500 AED will be charged. You will be required to pay these amounts immediately upon notification 

  1. Insurance Terms – Car rental

All our vehicles are comprehensively insured. driver, passenger and third-party liability is provided. It is your responsibility to ensure that you conduct a thorough inspection of the vehicle prior to check-out and to ensure that all pre-existing damages are recorded on the vehicle. Your liability will be limited to AED 15,000 plus 20% of repair cost + VAT. In case of an accident that is your fault, in where a red-colour report will be provided by the police, your liability will be limited to AED 15,000 plus 20% of repair cost and total days of the road. All insurance and damage claims will require a police report in order to be processed Damage caused to our vehicle for which a third-party is not identified, for which a police report has not been produced or which results in the insurance claim being denied will be charged in accordance with the Elite Rentals Dubai Damage Rate. Repairs done by third-party garages and mechanics and not done by Elite Rentals Dubai will not be acceptable and will breach the contract. Note that, as is common in the industry in this region, damage to tires, wheels and rims is not included as part of the insurance coverage and the renter is responsible for the cost of repair or replacement.
